Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and the operator of kinkyorvanilla.com (the “Site,” “we,” “us,” or “our”). By accessing or using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, do not access or use the Site.

1. Adult content & eligibility

The Site contains sexually explicit, adults-only material. By entering you represent and warrant that: (a) you are at least 18 years old and have reached the age of majority in your jurisdiction; (b) it is lawful for you to access adult material where you live; (c) you are voluntarily seeking such material for your own private enjoyment; and (d) you will not permit any minor to access the Site or any content from it. You reaffirm these representations each time you enter.

2. Your account

• you own the content or have all rights, licenses, and permissions necessary to submit and publish it;
• every identifiable person depicted has given informed, voluntary consent to the creation and public display of the content on the Site;
• the content does not infringe any third party’s intellectual-property, privacy, publicity, or other rights; and
• the content complies with these Terms and all applicable laws.

4. Licence you grant

You retain ownership of your content. By submitting content you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, encrypt, back up, reproduce, adapt (including creating resized and watermarked derivatives), moderate, and publicly display the content on and in connection with the Site and its promotion. This licence continues for content that remains published; it ends for the public copy when the content is removed, though encrypted originals and records may be retained as described in Section 8 and our Privacy Policy.

5. Prohibited content & conduct

You must not submit, request, or facilitate any content that: depicts anyone under 18 or presents an adult as a minor; depicts real non-consensual acts, coercion, trafficking, or a person who has not consented to being shown; depicts bestiality, incest, real violence, or serious injury; is unlawful, defamatory, or invades another’s privacy; or violates any law. You also must not: harass, threaten, dox, or impersonate others; upload malware; scrape, crawl, or bulk-download content or otherwise circumvent access controls, signed links, watermarks, or rate limits; manipulate ratings or rankings; or use the Site for spam or commercial solicitation without our written permission.

6. Moderation & removal

All submissions are subject to review. We may approve, reject, remove, hide, age-restrict, or refuse any content at our sole discretion, with or without notice. We are not obligated to publish anything. Suspected illegal material is removed, preserved, and reported to the appropriate authorities and organizations (including, where applicable, the CyberTipline). We cooperate with lawful requests from law enforcement.

7. Intellectual property & DMCA

The Site and its original design, code, and branding are owned by us and protected by law. Content belongs to the users who submitted it. If you believe content infringes your copyright, follow the notice-and-takedown procedure in our DMCA Policy. We terminate repeat infringers.

8. Ratings & user interactions

Ratings, scores, comments, and rankings reflect user opinions and automated calculations; they are not statements of fact by us and may change. You interact with other users at your own risk. We do not verify the identity of users beyond what these Terms require.

9. Third-party services

The Site relies on third-party infrastructure (for example, hosting, content delivery, email, bot-protection, and analytics providers) and may link to third-party sites. We are not responsible for third-party services or content, and their terms and privacy practices are their own.

10. Termination

You may stop using the Site at any time and may delete your account. We may suspend or terminate your access at any time for any reason, including violation of these Terms. Sections that by their nature should survive termination (including Sections 3–5 and 11–15) will survive.

11. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT IS ACCURATE OR RELIABLE. YOU ACCESS THE SITE AND ITS CONTENT AT YOUR OWN RISK.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, OPERATORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. 13. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your content, your use of the Site, or your violation of these Terms or any law or third-party right.

14. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which the Site’s operator is established, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where applicable law grants you non-waivable rights in your local courts. You agree to resolve disputes on an individual basis and, to the extent permitted by law, waive any right to participate in a class action.

15. General

If any provision is held unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and the policies referenced here, are the entire agreement between you and us regarding the Site. We may update these Terms; material changes will be posted here with a new “last updated” date, and continued use after changes means you accept them.
